These terms and conditions cover the contractual relationship between Bakeria and the purchaser (hereinafter referred to as “customer”) of any products offered through the Online Shop. No other terms or conditions are valid unless agreed in writing. Once an order is entered, the customer is deemed to have accepted the terms and conditions published on www.bakeria.ch.
All prices are in Swiss francs (CHF), but can be subject to errors and adjustments by Bakeria.
Products featured online represent a formal offer by Bakeria that can lead to a binding transaction. A contract ensues when a customer clicks the “Confirm Order” button, leading to a formal order of the product(s) placed in the shopping cart. Confirmation of receipt of the order, which is also an order confirmation, follows by email shortly afterwards.
Ordered items are delivered as quickly as possible, according to availability. Partial shipments are possible. Completion deliveries are shipped free of charge.
Shipping costs are calculated automatically. All deliveries are handled by DPD. Deliveries to a customer-defined location are handled at the customer’s risk and expense. Bakeria arranges shipping insurance only if a customer specifies this requirement in writing. Deliveries are offered within Switzerland only. Shipment is free for orders from CHF 100.00.
Bakeria extends a guarantee in accordance with the warranty terms of the manufacturer. Visible defects must be communicated in writing by the customer within 8 (eight) days of delivery of the product. Otherwise, the delivery will be regarded as accepted.
Wrongly ordered goods can be exchanged within 7 (seven) days and must be returned unused and in their original wrapping. The customer bears the mailing costs. Food products cannot be returned.
Invoices must be paid in full immediately on receipt of the invoice, using the attached payment form. Bakeria GmbH ("Bakeria") reserves the right to demand a prepayment for orders from CHF 150.00 and/or for new customers.
The goods remain the property of Bakeria until payment is made in full. A reminder fee of CHF 20.00 will be charged after the second payment reminder.
Bakeria does not share, or sell, customer data to third parties. Customer data is used only to process customer orders.
As far as is legally permissible, Bakeria assumes no liability for the improper handling or use of any of the products sold by Bakeria. Bakeria is not responsible for the contents of any of its partners’ web pages, and therefore cannot be held liable; the partner companies’ terms and conditions apply.
Any legal proceedings between Bakeria and the customer are subject exclusively to Swiss law. The court of jurisdiction for any claims relating to the contract is Zürich.
